Terms and conditions // Terms of Service

These Terms and Conditions / Terms of Service govern your use of all software, web applications, SaaS platforms, and services (collectively referred to as "Software") provided by Alphanso Technology and Alphanso Innovations Private Limited, the subsidiary of Alphanso Technology (hereafter referred to as “Alphanso Tech,” “we,” “us,” or “our”). By accessing or using any of our products or services, you acknowledge and agree to be bound by these Terms.

1. Ownership and Licensing

All Software offered by Alphanso Tech is the intellectual property of Alphanso Technology and is protected by applicable copyright, trademark, design rights, and retained IPR.

When you purchase or access any Software:

You are granted a single-domain license to install and use the Software on one live domain.
Subdomains and local installations may be used for development and testing only.
Use across multiple live domains or clients requires additional licenses.
Any violation of licensing terms may result in immediate termination without refund.

2. Authorized Use

The Software license is granted solely to the individual or company (“Client”) completing the purchase
Redistribution, resale, leasing, sublicensing, or transferring the Software or its components (code, design, database structure, UI, or assets) is prohibited.
Modification for internal use is allowed.
Modified versions may not be sold, redistributed, or monetized without Alphanso Tech’s written approval.

3. Acceptance of Terms of Use by the Customer

By downloading, installing, or using our Software, You:

Agree to abide by these Terms and any updates we may publish.
Accept full responsibility for the lawful use of the Software.
Ensure all usage aligns with applicable licensing and regulatory requirements.

4. Payment Terms

Full payment is required before product delivery, installation, or access.
Accepted payment methods include UPI, Stripe, credit/debit cards, bank transfer, and net banking.
All pricing is exclusive of applicable taxes and payment gateway charges unless otherwise stated.
Initiating a payment signifies agreement with these Terms.

Pricing Model Clarification

Recurring Pricing Applies to SaaS platforms such as EventZ, Melodify, PlayNow, and similar cloud-hosted solutions.
One-Time/Non-Recurring Pricing Applies to source-code licenses, self-hosted products, and custom development projects.
Additional services, including upgrades, support extensions, integrations, or new features, may require separate fees.

5. Customization and Technical Support

Clients may customize the Software based on business needs.
Modifications by the Client or third parties are not covered under free support.
Free support covers:
- Bug resolution
- Clarifications on software architecture or workflow
- Installation guidance within reasonable scope
Not Included in Free Support:
- Custom features or enhancements
- UI/UX redesign
- Server/hosting-level issues
- Fixes related to third-party modifications or integrations
Any custom feature development or workflow modification will be billed separately.

6. Trademarks and Clone Disclaimer

The term “Clone” is used only to describe functional similarity to well-known platforms.
Alphanso Tech develops all products independently from scratch.
Alphanso Tech is not affiliated with or endorsed by any referenced brands, companies, or platforms.

7. Limited Liability

Alphanso Tech will not be liable for:

Direct or indirect damages
Business loss, revenue loss, or data loss
Server misconfigurations or third-party hosting failures
Issues resulting from unauthorized modifications or misuse

Use of the Software is entirely at the Client’s own risk.

8. Indemnification

The Client agrees to indemnify and hold Alphanso Tech harmless from any claims, liabilities, losses, or legal expenses arising from:

Use or misuse of the Software
Violation of these Terms
Intellectual property infringement caused by client-side changes
Third-party disputes

9. Non-Disclosure (Confidentiality)

Both Alphanso Tech and the Client agree to:

Protect and maintain confidentiality of sensitive or proprietary information
Not disclose any shared information, documents, or code to third parties without written permission
Use shared information solely for project and service purposes

10. Governing Law

These Terms are governed by the laws of Rajkot, Gujarat, India, unless superseded by applicable national regulations.

11. Refund & Cancellation Policy

All digital product sales are final and non-refundable once the Software is delivered.
No refunds apply to custom development, integrations, or modifications.

Refunds for Billing Errors

Refunds may be considered only in cases of:
- Duplicate payments
- Incorrect billing
- Error from the payment gateway
Upon approval:
- Refund initiation will occur within 7 business days
- Funds may take 5–10 business days to reflect in the original payment method (gateway policies apply)

Chargeback Policy

Any payment dispute or chargeback will:
- Immediately suspend all licenses
- Halt access to updates, support, and services
- Remain unresolved until the dispute is cleared or withdrawn
